1) Scope of Application
1.1 These General Terms and Conditions (GTC) of Just A Bean – Michel & Lee Laubscher (hereinafter referred to as the “Seller”) apply to all contracts concluded between a consumer or entrepreneur (hereinafter referred to as the “Customer”) and the Seller regarding the goods and/or services presented in the Seller’s online shop. Any inclusion of the Customer’s own terms and conditions is hereby rejected, unless otherwise agreed.
1.2 These GTC also apply to contracts for the delivery of vouchers, unless expressly stated otherwise.
1.3 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
An entrepreneur is any natural or legal person or partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade or independent professional activity.
2) Conclusion of Contract
2.1 The product descriptions contained in the Seller’s online shop do not constitute binding offers on the part of the Seller but are intended to enable the Customer to submit a binding offer.
2.2 The Customer can submit an offer using the online order form integrated into the Seller’s online shop. By submitting the order form after entering personal details and clicking the button that concludes the ordering process, the Customer submits a legally binding offer to purchase the goods and/or services contained in the shopping cart.
2.3 The Seller may accept the Customer’s offer within five days by:

sending the Customer a written order confirmation or an order confirmation in text form (e.g., email or fax), whereby receipt of the confirmation by the Customer is decisive; or

delivering the ordered goods to the Customer, whereby receipt of the goods by the Customer is decisive; or
-
requesting payment from the Customer after placing the order.
If several of the above alternatives occur, the contract is concluded at the time the first of these events occurs. If the Seller does not accept the Customer’s offer within this period, the offer is deemed rejected, and the Customer is no longer bound by it.
2.4 If the Customer selects “PayPal Express” as a payment method, by clicking the final order button, the Customer simultaneously authorizes payment via their payment service provider. In this case, the Seller declares acceptance of the Customer’s offer at the moment the payment process is triggered.
2.5 The period for acceptance of the offer begins on the day following the submission of the offer and ends at the end of the fifth day after submission.
2.6 When submitting an order via the Seller’s online order form, the contract text is stored by the Seller and sent to the Customer together with these GTC in text form (e.g., email, fax, or letter) after the order is submitted. The contract text is also archived on the Seller’s website and can be accessed via the Customer’s password-protected account if one has been created prior to the order.
2.7 Before placing a binding order via the online order form, the Customer can review and correct their input at any time using standard keyboard and mouse functions. Before the order is submitted, all entries are displayed once again in a confirmation window where further corrections can also be made.
2.8 The contract language is German.
2.9 Order processing and communication take place by email and automated systems.
The Customer must ensure that the email address provided is accurate so that messages from the Seller can be received. In particular, if spam filters are used, the Customer must ensure that all emails from the Seller or third parties involved in order processing can be delivered.
3) Prices and Payment Terms
3.1 Unless otherwise stated, the prices listed in the Seller’s shop include statutory VAT and other price components. Any additional shipping or delivery costs will be indicated separately in the product description.
3.2 The Customer can choose among the payment options indicated in the Seller’s online shop.
3.3 If advance payment is agreed, payment is due immediately upon contract conclusion.
3.4 If the payment option “invoice” is selected, the purchase price becomes due after delivery and invoicing.
3.5 For invoice payments, the amount is due within 14 days of receiving the invoice, unless otherwise agreed. The Seller reserves the right to perform a credit check before accepting invoice payments and may refuse this option in case of negative results.
3.6 If payment is made through Wix Payments, the transaction is processed via Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (“Stripe”).
The specific payment methods available through Wix Payments are shown in the online shop.
Stripe may use additional payment services, each subject to their own conditions, which will be communicated to the Customer when applicable. Further details are available at: https://de.wix.com/about/terms-of-payments

If PayPal is selected, payment processing is carried out via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg, under the PayPal User Agreement available at:

This requires a PayPal account or the creation of one.
4) Delivery and Shipping Terms
4.1 Goods are generally delivered by shipping to the address specified by the Customer during the ordering process. For PayPal payments, the delivery address registered with PayPal at the time of payment is decisive.
4.2
If delivery to the Customer is unsuccessful and the goods are returned to the Seller, the Customer bears the cost of the failed shipment.
4.3 The risk of accidental loss or deterioration of the goods passes to the Customer when the goods are handed over to the transport company.
4.4 For self-collection, the Seller will inform the Customer by email when the order is ready for pickup.
After receiving this notification, the Customer may collect the goods by prior arrangement with the Seller. No shipping costs apply in this case.
5) Liability for Defects
The statutory liability for defects applies.
6) Redemption of Promotional Vouchers
6.1 Vouchers issued free of charge by the Seller as part of promotional campaigns with a defined validity period (hereinafter “promotional vouchers”) cannot be purchased and may only be redeemed in the Seller’s online shop within the indicated period.
6.2 Certain products may be excluded from voucher campaigns if specified in the voucher details.
6.3 Promotional vouchers can only be redeemed before completing the order process. Retroactive application is not possible.
6.4 Multiple promotional vouchers may be used in a single order, unless stated otherwise.
6.5 The value of the order must equal or exceed the value of the voucher. Any remaining balance will not be refunded.
6.6 If the value of the voucher is insufficient, the remaining balance can be paid using any other payment method offered by the Seller.
6.7 Voucher balances are neither paid out in cash nor bear interest.
6.8 If the goods purchased with a promotional voucher are returned under a withdrawal right (if applicable), the voucher will not be refunded.
6.9 Promotional vouchers are intended exclusively for the person named on them. Transfer to third parties is excluded. The Seller reserves the right, but is not obligated, to verify the eligibility of the voucher holder.
7) Redemption of Gift Vouchers
7.1 Gift vouchers purchased through the Seller’s online shop (hereinafter “gift vouchers”) may only be redeemed in the same online shop, unless otherwise stated.
7.2 Gift vouchers and remaining balances can be redeemed until the end of the third calendar year following the year of purchase.
Any remaining balance will be credited until the expiration date.
7.3 Gift vouchers can only be redeemed before completing the order process; retroactive redemption is not possible.
7.4 Multiple gift vouchers may be redeemed per order.
7.5 Gift vouchers can only be used for the purchase of goods, not for the purchase of additional gift vouchers.
7.6 If the value of the gift voucher is insufficient, the remaining balance can be paid via any other payment method available.
7.7 Gift voucher balances are neither paid out in cash nor bear interest.
7.8 Gift vouchers are intended solely for the named recipient. Transfer to third parties is excluded.
The Seller reserves the right, but is not obligated, to verify the ownership of the voucher.
8) Applicable Law and Jurisdiction
All legal relationships between the Customer and JUST A BEAN GmbH are governed by Swiss law.
The exclusive place of jurisdiction is Liestal, Switzerland.
